Man in N.J. Charged with Having Sex with a Corpse

Mara Franklin, 53, who lives with the children, was arrested Saturday at home. When arrested, she was verbally combative and slurring her speech, an arrest report states.
She was charged with one felony count of aggravated battery on a pregnant person and two felony counts of child abuse.
The other children are an 11-year-old boy and a 12-year-old girl, sheriff's spokeswoman Debbie Carter said.
Franklin remains in Orient Road Jail. Bail was set Sunday at $7,500.

SPOKANE -- A state lawmaker from southwest Washington in Spokane for a legislative retreat last week may have done some socializing here that now has the attention of local detectives.
State Representative Richard Curtis (R-La Center) was in Spokane last week and reportedly had consensual sex with another man at a downtown hotel that later led to blackmail. However Curtis says there was no sex and he isn't gay. Now Spokane police are trying to determine if Rep. Curtis did in fact have a sexual encounter here that made him a target for extortion.
While most of the legislators attending the Spokane retreat stayed at the Red Lion Hotel it appears Richard Curtis ended up in a room here at the Davenport Tower. The new hotel has the latest in video surveillance equipment in its lobby and major crimes detectives executed two search warrants there hoping to review Curtis' activities in public areas of the building.
Investigators are also looking for a still unnamed man who was with the representative. The pair reportedly had consensual sex inside the hotel and later Curtis was threatened the liaison would not remain a secret unless he submitted to the extortion.
The alleged late night encounter is in sharp contrast to Curtis' political persona. While in Olympia Curtis has voted against domestic partnerships for gay couples and opposed a bill that would have outlawed discrimination based on sexual orientation.
The Air Force veteran was also the co-sponsor of state legislation that would have barred protests within 500 feet of funerals.
It's still not clear who reported the attempted shakedown to Spokane police or if the two-term state representative is cooperating with investigators.

LEWISBURG, W.Va.—Using a video camera and raw chicken, state officials hope to learn whether the king of the jungle is prowling the woods of West Virginia.
Bow hunter Jim Shortridge believes he saw a full-grown, male African lion weighing between 250 and 300 pounds at the foot of Cold Knob Mountain earlier this month. The state Division of Natural Resources confirmed that at least one other person has reported seeing the lion.
Using a camera normally employed to catch people dumping trash illegally, the state Department of Environmental Protection has joined with Greenbrier County Animal Control Officer Robert McClung and exotic animal expert Jim Forga to see if they can substantiate the sightings.
Twenty pounds of raw chicken left on the site last week were devoured, but McClung said that doesn't prove the lion's existence.
"Anything could have eaten that," he said.
If officials do spot the lion on videotape, they may set a bear trap for the animal. If caught, it would be turned over to Forga, who runs Tiger Mountain Refuge in Rainelle, a shelter for exotic animals.

Actor Doesn't Want Zoo to Build Exhibit
Judge Reginald A. Dunn has rejected arguments by the city that the complaint filed by the 77-year-old actor and real estate agent Aaron Leider lacks a legal basis.
Culp and Leider want to stop the zoo from building a $40 million elephant exhibit. They accuse zoo authorities of withholding medical care from elephants and keeping them cramped in small places, and don't want the zoo to keep any elephants.
Lawyers for the city argued Monday that the pair's complaint was political, not legal, but the judge rejected that argument and refused to dismiss the lawsuit.

Man convicted of tossing puppy off balcony in fight with girlfriend will spend next three years tossing salad
CHARLESTON, S.C. - An incredulous judge sentenced a man to three years in prison for tossing a 10-week-old puppy off an apartment balcony during an argument with his girlfriend.
The Yorkiepoo, a cross between a Yorkshire terrier and a poodle, was in a soft-sided container but suffered head injuries and had to be put to death.
Javon Patrick Morris, 22, apologized for throwing the puppy off the third-floor balcony last March and pleaded guilty to animal cruelty.
“You mean he threw a helpless animal off three floors because he was mad at someone?” Circuit Judge Edward Cottingham asked a prosecutor before issuing the sentence Thursday.
The judge, who has owned nine dogs, said he was obligated to issue a tough sentence.
“There is nobody in this world that can understand that,” Cottingham said.
He sentenced Morris to five years, suspended to three years in prison and two years of probation. Morris, who will be eligible for parole in 20 months, also was ordered to get anger management counseling.
“I’ve got to send a message to all dog lovers that we are going to protect that interest in our courtrooms,” Cottingham said.

Marganski said. "That's what is happening here."The school is based on teaching basic Wiccan beliefs, along with other unusual fare, such as aromatherapy and zombies.Among the tactics that several locals have taken against the school is a anti-Wiccan billboard that reads "Worship the Creator not Creation."Following a meeting last Wednesday, local youth minister Andy Thomas explained that such open hostility is based on a feeling of defensiveness."Rossville has fallen on hard times," Thomas told the Tribune. Pub landlord Anthony Morgan, 70, attacked his half-naked wife with a child's cricket bat when he found her enjoying a Chinese takeaway with another man, a court heard today.
He came across wife Elaine - his partner for 21 years - wearing only a towel at the home of Stephen Clarke.
She claimed to have stripped off so her clothes would not get greasy from the takeaway, Newport Crown Court heard.
Morgan, who runs Potters Pub in Aberbeeg, Abertillery, South Wales, entered Mr Clarke's flat and hit the pair with the bat, breaking his wife's nose.
He was given a nine-month prison sentence, suspended for a year, and ordered to pay £500 towards the prosecution's costs.
The court heard how Morgan, who served with the armed forces in Malaya in the 1950s, immediately handed himself in to police in July.
David Webster, mitigating, said Morgan's relationship with his wife was over "and there will be no reconciliation".
"He is thoroughly ashamed of what he did that night," he said.
Sentencing, Judge Roderick Denyer QC said Morgan, who pleaded guilty to aggravated burglary, would have to report to a probation officer.
"They can just keep an eye on you because we don't want you going off the rails again," he said.
The judge heard how Morgan was highly regarded in his community and how he was a "man who helps other people when he doesn't have to help other people".
"You clearly run a good pub. Everyone says so," Judge Denyer said.

KIDS WANT CANDY
thats all it is. kids want to go and get candy. if you dont want to hand it out its either because you are 1. cheap or 2. stupid.
1. your cheap because candy is cheap and the bars are small and you should get egged if you dont.
2. stupid because you believe that an imaginary guy in the sky will get mad at you for partaking in the holiday.
lets be honest "trick or treating" isnt even fun anymore. in pittsburgh you can only go out between 6 and 8. it isnt even dark. most of the homes dont give out candy. its a veritable suckfest.
when i was younger we left as soon as my parents would let us. we were out until 10:30 or 11. we hit every house that we could. you didnt have enough steps that i wouldnt walk up. i would have climbed a mountain to get candy. we didnt have parents walking us around. we were on our own. if you didnt give out candy your windows got soaped (or if i was in a bad mood waxed) and we egged your house. dont give us an apple because that would only dent your aluminum siding when we threw them back at your house. we planned our routes so as to hit the maximum number of homes in the given time, periodically circuling back to your house to drop off your booty (6 pillowcases was tough to carry).
it seemed darker and scarier when i was younger but yet i never worried that someone would give me poison candy or kidnap me. it was some of the best times of my young life but like everything else its just not as much fun anymore.
so if your just an old codger whos too lazy to answer your door then i hope your house gets egged and if your an idiot who worries that god will be mad at you for participating..get over yourself and i hope you get egged double.

Officials say Evans was hitch hiking down Interstate 30 in Arlington when a white female known only as ‘Angie’ picked him up.
Soon thereafter, the 42-year-old driver invited Evans back to her horse barn just outside of Wolfe City.
When they arrived, the two became intimate, and officials say ‘Angie’ asked Evans to perform oral sex on her.
That’s when they say Evans got quite a surprise.
"(When he did) comply with the female subject, he found out it was in fact not a female, but a male," Sheriff Moore said.

She teaches mentally disabled teens in Tampa
The 33-year-old Middleton High educator violated her position of authority by having sex with one of her students, a 16-year-old, police say.
Butler of 3507 N Tampa St. faces felony charges of engaging in lewd or lascivious behavior, jail records show. She was released from the Orient Road Jail early Wednesday morning on $7,500 bail.
Police say she and the teenager had sex up to a dozen times, including a Monday meeting at Butler's home.
Butler, who did not return a call for comment, has been suspended with pay, according to Hillsborough school spokeswoman Linda Cobbe.
The teacher has no criminal record in Florida, records show.
She joined Middleton's faculty at the start of this school year and taught students considered "educable," meaning they are the least affected of those classified as mentally disabled. The students have a degree of mental retardation and may exhibit judgment problems, Cobbe said.
Prior to that, Butler taught as a substitute at Coleman Middle School and Bryant Elementary School during the 2006-07 school year, Cobbe said.
Police say they learned of the sexual relationship in an unusual way.
Plainclothes police officers spotted six teens speeding away on bicycles Tuesday while conducting surveillance at the Meridian Apartments at 2450 Hillsborough Ave. The teens wore green and white Halloween skeleton gloves in the sticky 80-degree weather. The teens then got into a blue Jeep Grand Cherokee.
After the Jeep twice crossed the double-yellow center line, police pulled it over, Davis said.
Butler owned the vehicle, Davis said. The teenager driving had no license. He told police that his friend, Butler, let him use her car.
Butler was called to come and pick up the Jeep. While police waited for her, officers talked with one of the other teens, who told them the driver was in a relationship with the teacher.
The officers suspected a sexual relationship, and they questioned Butler. At first, she said the relationship was platonic, but then she changed her story, telling police the two had sex, Davis said.
Before Butler started her teaching career, she worked at Brandon Lakes Animal Hospital, according to Cobbe. Workers there declined to comment, but one of Butler's job references remembered her work with animals.
Diane Simpkinson, an elementary school teacher, met Butler through the animal clinic. She never observed Butler's teaching, but Simpkinson said she was impressed with Butler's personality. Butler cared for Simpkinson's home and a litter of puppies when she was out of town.
"I had total trust in her," Simpkinson said. She said Butler seemed responsible, like a "very positive person."

Girl suspended after telling on teacher
TAMPA -- About two weeks ago, a girl started talking at Middleton High, telling people that a special education teacher for the mentally disabled was sleeping with one of her students.
Middleton principal Carl Green talked with the teacher, Christina Butler, 33, and the 16-year-old boy. Both denied it, said Hillsborough school spokesman Stephen Hegarty. The girl continued to talk, though, saying the teacher should be fired. Administrators suspended the girl, "pending conference," which means until she and a parent or guardian sat down with an administrator to talk.
"He denied it. She denied it. We had nothing more than a rumor on our hands," Hegarty said.
It's now more than a rumor.
Tuesday police arrested Butler. Police say Butler told them she had sex with the student up to a dozen times, including a meeting Monday at her home, a spacious gray bungalow on Tampa Street.
She was released from jail after posting $7,500 bail. Only a big barking dog came to her door Thursday at noon.
Hegarty said he was not aware of the school's handling of the rumor when he spoke with reporters Wednesday. He said he learned details after speaking with the principal, who was out of town.
The girl was not suspended as punishment, he said, and she is now back in school.
After the girl's original complaint, Butler called the teacher's union. School administrators also were "taking steps to get more supervision for Butler's class," Hegarty said.
County Commissioner Kevin White, whose daughter attends Middleton, said he was "bewildered" when he learned that a student was suspended after telling on Butler.
"It was just obviously dismissed as a fabrication," White said.
Dismissing the allegation would be like ignoring a complaint of a gun on campus, he said.
"It makes me so happy that this is my daughter's last year at that school," he said. "I think the bottom line is when we have people in power they need to act responsibly."

The side of Hailey's face hit one of those posts on the roadside opposite the lake. She wasn't wearing a helmet, but doctors have said that probably wouldn't have mattered. Lake Haven Drive, which intersects the street Hailey lives on, was built between 1996 and 1998, the lawsuit says. The suit cites a St. Charles County ordinance that requires subdivision roads to have a grade of no more than 12 percent. County Counselor Joann Leykam said the 12 percent standard had been in place since at least 1959.The lawsuit doesn't specify the road's slope, but O'Leary said experts had determined that it exceeds the county's standard as well as nationally accepted standards. A pastor faces a parishioner's salacious allegations.
NEW PORT RICHEY -- They are allegations that could bring ruin to a man of God.
Last summer a male parishioner said he awoke to find his Baptist minister had partially undressed him, straddled his naked lap and kissed him on the chest.
The parishioner went to the Sheriff's Office. Detectives had him confront Ronald Smart over the phone -- a recording that was played for the jury Tuesday at the pastor's trial for misdemeanor battery.
"Why did you even do this to me?" the parishioner said.
The leader of Union Missionary Baptist Church offered nothing save calm words.
"If you want to sit down and talk I will, but for me I have to move on, man," Smart said. "I just have to move on. ... I prayed about things, about you, about my family and friends, I prayed over things. I have to move on."
"Did you think it was right to just touch me like that?" the parishioner said. "Does (the pastor's wife) Cheryl know about this?"
"Whatever transpired, if I had an accommodation with you or shared something with you," Smart said, "those things I shared with someone as an equal. ..."

ATLANTA, Oct. 24 (UPI) -- The Tupac Amaru Shakur Center for the Arts in Georgia has been vandalized and a noose found tied around the neck of a statue of the slain rap idol.Shakur was the victim of a 1996 drive-by shooting.The Tupac Amaru Shakur Foundation said Wednesday the De Kalb County, Ga., Sheriff's Office is investigating last weekend's vandalism at the Stone Mountain center as a hate crime.Early Saturday morning, vandals defaced the building and left a noose around the neck of the bronze statue of Shakur located in the center's peace garden. Later in the weekend, the statue was plastered with handbills covered in rants including references to Sept. 11, 2001, and Hurricane Katrina, as well as vague threats against various record companies and rappers, the foundation said.A male suspect has been arrested in connection with the incidents."We thank everyone for their prayers and support. Although our hearts are temporarily in pain, our spirits have already forgiven the perpetrators. Hate comes in all colors and genders, therefore, we will use this act of hate and ignorance to bring our community together and to pray for the healing of those who harbor such feelings," Shakur's mother, Afeni, said in a statement.

WINDHOEK, Namibia — Sixty-eight villagers in northern Namibia were hospitalized last week after eating a dog that had been killed by disease, the local daily The Namibian reported Wednesday.
The paper said the dog's owner had killed it after it contracted an unknown skin disease and ordered it to be burned. Instead, the inhabitants of Oikokola village insisted on eating the meat, which was also shared with people from the nearby Onepandaulo village.
Naftali Hamata, the director of health for northern Namibia, said the villagers were treated at two of the area's major hospitals and that most had recovered. He warned against eating dog meat or the carcass of any sick animal.
Dog meat is considered a delicacy among tribes in northern Namibia, and calls by animal rights organizations to end the practice are ignored.

What a hero............
LEWISBORO, N.Y. — New York state police say a teenage firefighter in Westchester County has admitted to setting a blaze at a local church so that he could gain attention as a hero.
Police say 18-year-old Christopher Iacovino was charged with third-degree arson, a felony, in connection with a fire Monday at St. Paul's Chapel in Lewisboro.
Investigator Michael Honig says the fire merely scorched a back staircase leading into the church. No one was hurt.
The teenager couldn't be reached Monday. His mother, Marianne Iacovino, says her son is a "really good kid" and that he is "just a little confused."
The teenager is being held at a local jail. Bail is set at $5,000.
this story is as old as time. voluteer firefighters are always setting fires. every time you have a serial arsonist its always a volunteer fireman.

David Copperfield designed part of his show around "a system for picking up women," which may explain the FBI's interest in his camera system and hard drive, sources told TMZ.
Last week, the FBI raided Copperfield's Las Vegas warehouse and seized digital cameraequipment and a hard drive to a computer after a Seattle woman accused him of sexually assaulting her in the Bahamas.
During his show, Copperfield goes into the audience and chooses women to come on stage. If he likes a woman, he'll use code words with assistants like "mama" and "secrecy," TMZ reported.
The assistants mark the women on a map of the inside of the Hollywood Theater at MGM Grand. After the show, the women are brought backstage, and told that Copperfield may use them in his show when he comes to their hometown.
They are then photographed with a digital camera, asked questions like, "What is your favorite men's cologne?" and "Where do you like to vacation?"
One of those vacation spots mentioned by staff is the Bahamas, TMZ reported, where the accuser claims she was assaulted. Copperfield owns a cluster of islands in the Bahamas — which he bought for $50 million.
In response to the TMZ story, Copperfield's attorney re-issued his earlier statement: "It is important these allegations be put into perspective. An unidentified woman has made serious allegations against David Copperfield. Although authorities have not revealed her identity to us, we know these allegations are false because David Copperfield has never forced himself on anyone."

MIAMI BEACH, Florida — One of People Magazine’s former Most Eligible Bachelors, Gary Zerola, was arrested Friday for allegedly drugging and raping a college student in Miami-Dade County, Fla., according to MiamiHerald.com.
The Web site reports the 36-year-old Boston defense attorney attacked the woman inside the Catalina Hotel in Miami Beach, forcing her to swallow pills before sexually assaulting her.
Zerola, who is already facing sexual assault charges in two other cases in Massachusetts, claims he never had sex with the woman, MiamiHerald.com reports.

Jeffrey Weinsier of WPLG-TV, an ABC network, was taken into custody Tuesday at Miami Central High School after ignoring several warnings not to walk on school property, Miami-Dade schools police said.
"Kindly go across the street now," an officer is shown telling Weinsier during the videotaped encounter.
"I'm not," Weinsier replied. The officer then handcuffed him.
Weinsier, 40, was charged with possession of a firearm on school grounds, trespassing on school property with a weapon and resisting officers without violence.
The photographer working with Weinsier, Frank Debesa, said afterward: "Jeff did have a gun on him."
Weinsier began carrying a gun after he received death threats stemming from a series he did about unsanitary conditions at restaurants, according to the station.
"At this point, Channel 10 is still reviewing the circumstances surrounding today's arrest," said Dave Boylan, the station's vice president and general manager.
Weinsier has a concealed weapons permit, but state law prohibits anyone from being armed at schools, police Detective Ed Torrens said.
Weinsier was released from jail on $11,000 bond.
"I've been advised not to say anything," he told Channel 10 afterward. "The videotape speaks for itself. ... I was not trespassing."
A telephone message left on his work voice mail by The Associated Press was not immediately returned.

In rare display of common sense, city votes to not reappoint judge in $54 million pants lawsuit
A city commission on Monday voted against reappointing Roy L. Pearson Jr. to sit on bench at the Office of Administrative Hearings, a court that rules on cases involving D.C. agencies, The Post's Keith L. Alexander reports.

The commission's discussions are not public. Sources familiar with the deliberations said the panel hasn't drafted a letter formally notifying Pearson of its decision. Until that is done, the sources said, the decision is not final. The letter could be sent early next week, according to the sources, who spoke on the condition of anonymity because of the sensitive nature of the case.Pearson, pictured above, filed suit after the owners of Custom Cleaners in Northeast Washington allegedly lost a pair of pants he brought in for alterations. The case ended with a D.C. Superior Court judge's ruling in the cleaners' favor. Pearson later indicated he would appeal.

A PANDA bit a scavenger on his legs yesterday at the Beijing Zoo after the boy broke into the panda's habitat, Beijing media reported today.The incident happened around 1pm at the zoo in Xicheng District. An official from the zoo said a boy climbed into the park without buying a ticket and then jumped into the panda habitat, the report said. Media reports had conflicting account of his age, which is either 12 or 15. A witness surnamed Wang said the boy stayed outside the railings and shouted toward the pandas at first."He shouted 'I'm not afraid of a panda, I know karate,'" Wang said. "And then he sat on the cement platform inside the railings and jumped into the habitat."Wang said the boy used a bamboo stick to tease the male panda "Gugu," so the panda was enraged and rushed at the boy."The panda even followed him onto a slide and then bit him on the legs," Wang said."The boy cried for help and a foreign tourist threw a bottle of drinking water towards the panda, which scared it off," Wang said.An official in charge of the panda hall then persuaded the panda into its cage and rescued the boy, Wang said.Officials and police soon called an ambulance to send the boy, who was trembling and crying, to hospital, the report said. Doctors said his wound was very deep and the bone was exposed. He underwent surgery at Beijing Children's Hospital but doctors refused to reveal more details, the report said. CHARLESTON, W.Va. - More than a fourth of pregnant women in West Virginia smoked last year, putting themselves and their babies at risk.
The state's 27.3 percent maternal smoking rate was the highest rate in the country and nearly triple the national average, according to a recent report from the state Department of Health and Human Resource's Health Statistics Center. The state's rate was up slightly over the previous year and has hovered around 25 percent the past 10 years.
McDowell County had the highest rate of pregnant smokers, at more than 42 percent, the report said. The lowest rate, 15.8 percent, was in Monongalia County.
All total, smoking mothers across the state gave birth to about 5,500 babies last year.
"West Virginia has a virtual sustained epidemic of maternal smoking during pregnancy," said Dan Christy, who directs the Health Statistics Center. "It isn't healthy, and it's endangering the baby."
Smoking during pregnancy increases the risk of low-birth weight and premature babies, and can lead to a host of illnesses, including heart disease, breathing difficulties and mental health problems.
National researchers suggest pregnant smokers are typically poor, less educated and have less access to health care. The state's study found that a lack of education played a major role in West Virginia's numbers.
Christy noted that some women at a recent focus group meeting said they smoked during pregnancy because they thought they would have easier deliveries if their babies were smaller.
The state study found that more than half of women who didn't graduate from high school smoked while pregnant. It also found that more than 40 percent of West Virginia women covered by government-funded Medicaid health insurance smoked during pregnancy.
Christy said it's obvious that existing programs to curb smoking among pregnant women are not working.
National research released last month indicated the "quit for your baby" message is too simplistic an approach for many women. It also suggested that many pregnant women who smoke may also suffer from depression, which makes it even more difficult to kick the habit.
A committee of state health advocates recently issued a list of recommendations that include increasing the state excise tax on tobacco products and expanding the state tobacco "Quitline," which offers free smoking-cessation services to all pregnant women.
The committee also urged the state to increase funding for tobacco-prevention programs from $6 million a year to $14 million, as recommended by the Centers for Disease Control and Prevention.

Guess which teen carjacker resisted arrest.......
Police said Deron Mitchell, 17, took the car at the intersection of Kings Street at North Canal Street and sped away. A police officer spotted the allegedly stolen car at the intersection of Myrtle Avenue and West 22nd Street and tried to pull over the driver.
The driver accelerated, running several stop signs, police said.
Mitchell and Keith Rogers, 19, were apprehended when police said the car crashed through a mailbox and fence, hitting a parked car and one house.
Both Rogers and Mitchell are charged with armed carjacking and fleeing a law enforcement officer. Mitchell is also charged with resisting an officer.

A man is in jail in Southern Kentucky for downloading child pornography right in front of police.
Williamsburg Police say they were called to the Whitley County Library Friday afternoon after several people saw a man looking at child porn on the internet. A detective says he stood and watched as 43 year old Robert C. Hillard visited web sites showing children in sexual situations.

A 79-year-old man shot himself in the mouth with a flare gun Thursday morning, in an incident that Town of Tonawanda police are calling an apparent suicide.
Emergency crews responding to the 8:52 a.m. call of a man down on an Elmwood Avenue front lawn took the man to Erie County Medical Center, where he died about an hour and a half later.
The man, whose name was not released, apparently shot himself on his front porch before running toward the street, Capt. Jon Scott said.
The 12-gauge flare gun was the type commonly used to call for help by stranded boaters. While lacking the force of a traditional gun, the flare packs a high-intensity heat capable of doing major damage, authorities said.

A woman is dead after apparently shooting her husband and then killing herself in a domestic quarrel, according to the Volusia County Sheriff's Office.The incident began at about 2 p.m. Saturday when deputies responded to a 911 call saying that Teri Deuyour, 57, shot her husband Larry Deuyour, 51, at their Aquarius Avenue home near DeLand.Larry Deuyour was airlifted to Halifax Medical Center in Daytona Beach with gunshot wounds to the wrist, collarbone and back of the head. He checked himself out of the hospital later in the day.
After being spotted briefly by deputies outside of the house, Teri Deuyour barricaded herself inside and refused to come out. She talked briefly with deputies, but deputies did not hear from her for several hours. At about 5:45 p.m., deputies put tear gas into the house, but there was still no response. Finally, at about 7 p.m., Deuyour's body was found inside in the house next to a gun.Deputies believe Deuyour killed herself but said an autopsy will be performed to confirm the cause of death.

A man who pleaded guilty to shooting another has told a court he blames a severe allergic reaction to floor polish for a downward spiral in his life.
The Supreme Court in Adelaide has heard that Marco Battello, 43, shot a man three times with a pistol, in May last year.
The court heard he was jealous when he saw another man taking an interest in a woman he liked.
Battello drunkenly argued with the pair at a hotel, then went home.
The court also heard he changed his clothes at home in an attempt to disguise himself.
Some hours later, Battello went to a Kilburn address and shot the 40-year-old victim in the leg three times with a pistol.
Battello's lawyer said his client had led a stable life until he started installing floors in 1994.
Battello reacted adversely to the chemicals he used.
He suffered dermatitis and asthma and his former wife says he used to get angry and confused.
The court heard Battello was now allergic to many chemicals, as well as perfume and fly spray.
Battello will be sentenced later.

CHATTANOOGA, Tenn. — The mother of Eric Rudolph, the Olympic Park bomber and an anti-abortion extremist who bombed clinics, claims her son is enduring inhumane treatment in a federal maximum security prison in Colorado.
Patricia Rudolph said her son is denied books and family visits, and his mail is delayed for weeks.
"They're (the Federal Bureau of Prisons) a law unto themselves," Patricia Rudolph told the Chattanooga Times Free Press on Tuesday. "They should be the ones behind bars."
Patricia Rudolph, who lives in Florida, said she has sent letters raising issues about the treatment of her son to Bureau of Prisons Director Harley Lappin and to Sen. Mel Martinez, R-Florida, and Rep. Vern Buchanan, R-Florida.
She provided a copy of her letter to the newspaper, saying that censoring her son's books and letters is a violation of his rights.
"Is this the way a civilized country should treat even the worst of its members?" Rudolph wrote.
She also complained that the inmate next to Rudolph's cell was unsanitary and that the exercise pen for inmates is too small or closed when the prison is short-staffed.
Mike Truman, a spokesman for the Federal Bureau of Prisons, said officials would not comment on the complaints. The warden was not available for comment. Representatives for the Florida congressmen did not immediately return calls.
Emily Lyons, a nurse scarred and burned by Rudolph's bombing in Alabama, said she has no sympathy for complaints about the conditions where he is being held.
"Whatever they can take away doesn't bother me a bit," Lyons said. "He should have had the death penalty."
Bureau of Prisons regulations give wardens the right to reject correspondence by an inmate for "the protection of the public, or if it might facilitate criminal activity." That includes material "which may lead to the use of physical violence."
As recently as May, Rudolph mocked a victim of one of his bombings with letters posted online by a supporter.
Lyons' husband, Jeff, said in May he was concerned that the essays posted online could incite further violence against abortion providers.
In 2005, Lyons wrote a book with her husband titled "Life's Been a Blast." Jeff Lyons wrote his wife has endured more than 20 surgeries and was permanently and profoundly injured in the bombing.
"This is what he inflicted on us," Jeff Lyons said. "And his conditions are what he inflicted on himself."
Rudolph pleaded guilty in 2005 to four bombings, including one at the 1996 Olympics in Atlanta and one in 1998 at a women's clinic in Birmingham, Ala., that killed a police officer and injured Lyons.
He was arrested in May 2003 in Murphy, N.C., after a five-year manhunt. Rudolph is serving at the federal prison commonly called "Supermax" in Florence, Colo.
The facility is 100 miles south of Denver and houses terrorists and high-profile inmates, including Wadih El Hage, Osama bin Laden's former private secretary; Ramzi Yousef, the leader of the first World Trade Center attack in 1993; and "Unabomber" Ted Kaczynski.

Drinking buddies decide to resolve age-old "shovel vs. stabbing" debate. Apparently ended in draw
TAMPA - An argument between two men escalated into one being stabbed and the other hit with a shovel, the Hillsborough County Sheriff's Office reported Tuesday night. Both men, whose names were not released, are in their 20s, deputies said.
They were taken to Tampa General Hospital, authorities reported.
Deputies went to Silver Palm apartments at 2301 Benbow Court after an emergency call of a stabbing at 10:16 p.m.
The man who was stabbed was outside his apartment drinking with friends when the other man drove up. They argued, and the man who had driven up stabbed the other man in the chest.
The stabbing victim then grabbed a shovel and struck the attacker on the head, deputies reported.

Canadian ferry crews warned against smoking pot
Canada's Transportation Safety Board issued a warning note to BC Ferries Corp after the board said it had learned that that several crew members of the ferry Queen of the North, which sank last year after running into island, "regularly smoked cannabis between shifts, both on board and off the vessel".
The federal agency said it heard the allegations of marijuana use while investigating the sinking, but said there was no evidence that the bridge crew of the Queen of the North was under the influence of cannabis at the time of the accident on March 22, 2006.
The board, which has not yet released its report on the cause of the sinking, which killed two people, did not say from whom it heard the allegations of marijuana use, but its investigation has included interviews with all crew members.
"Ferry crews whose performance is impaired by cannabis are a clear risk to the travelling public," chairwoman Wendy Tadros said in a statement.
The board said it wanted BC Ferries, the British Columbia government-owned ferry service, to find out the extent of marijuana use on other ships in its fleet, and to review its policies on drugs and alcohol use. BC Ferries has not commented on the board's report.
The safety board said it would be monitoring the ferry service's actions on drug use, but did not say it planned any disciplinary action against either the company or crew members who might have used marijuana.

When officers arrived, they found him alert and talking, but trapped in the car. They learned about the cell phone and text message as they worked to rescue him.
Gillespie, who had turned 38 the day before, was charged with drunken driving and careless driving, police spokeswoman Kerry Delf said. His injuries were described as not life threatening, and no members of the train crew were hurt.
Delf said officers believe he was driving faster than the 35 mph speed limit as well as using his cell phone to send a text message. She said he tried to brake for the train, but it was too close.
"There are all kinds of ways to get distracted these days," said police spokeswoman Kerry Delf. "We don't recommend any of them while you're driving."
Last 'Rat Pack' member Joey Bishop dies
Although not as widely appreciated, it was Bishop with his deadpan delivery, dead-on timing and bottomless pit of jokes, who was "the hub of the big wheel," according to Rat Pack leader Sinatra himself.
Bishop, who also starred on two TV shows throughout most of the 1960s, died Wednesday at age 89. He turned out to be the Rat Pack's last man standing, having outlived Sinatra, Martin, Davis and Lawford.

POLICE REOPEN PROBE Says officers assaulted him with a screwdriver, claimed he had drugs
The Chicago Police Department has agreed to pay $4 million to a 23-year-old man who says police shoved a screwdriver into his behind.
The announcement came moments after a jury of nine women and men ruled that they believed Coprez Coffie over the two police officers who testified they had no idea where that screwdriver in their squad car's glove compartment came from.
"I just told my story because I wanted justice," said Coffie, who was 19 when the incident occurred. "People need to know what's going on."
The head of the Police Department's Office of Professional Standards, which earlier had cleared the officers of any wrongdoing, said Tuesday she now will re-open the investigation, as required by the city's new ordinance governing her office.
Coffie and his mother said the officers should be fired. Annette Coffie said it galled her during the trial to watch the officers testify that her son had drugs and that they never assaulted him: "... them sitting up there, saying that they did nothing," she said, her voice choking with emotion.
Coffie's attorney, Jon Loevy, said he is not optimistic the department will ever hold its own accountable.
"The Police Department does not do an effective job policing themselves. ... Why can't the Police Department see what everybody else sees?" said Loevy, who noted that in all six million-dollar-plus verdicts he has won against the department in recent years, OPS had exonerated the officers in every case. "And nothing is going to happen now."
After the verdict was announced, new OPS director Ilana Rosenzweig said, "We are supposed to review all cases settled by the Department of Law to examine any new evidence or different evidence that was presented in the trial and determine whether that has any impact on our investigation. We can change the outcome."
John Gorman, spokesman for Cook County State's Attorney Dick Devine, said "We'll take a look at any evidence that OPS brings to us."
There were tears on the officers' side of the courtroom and smiles and hugs on Coffie's side. The officers, Gerald Lodwich and Scott Korhonen, left without making any comments.
As the jurors -- three white men, four white women, one black woman and one Hispanic woman -- left the federal courthouse, they smiled and waved at Coffie and said "God bless you" and "Good luck."
Coffie, a bagger at Jewel Food Stores, said he would have good use for the money: "I'm going to take care of my son and my family. I'm going back to school."
As jurors deliberated over the weekend, Loevy and attorneys for the city agreed that if jurors ruled for the officers, Coffie would get nothing. If they ruled for Coffie, he would get $4 million and his attorneys $675,000 -- pending appeals, a Law Department spokeswoman said.
Lodwich referred any questions to the city's corporation counsel.
A relative of Korhonen's answered the door at his North Side home Tuesday night. She said the officer wasn't home, but she offered a comment:
"We think it is sad for someone to get money for something like this -- especially since it is not true," she said.

Malaysian woman claims rape after sex with 'wrong man'
The 40-year-old housewife in eastern Terengganu state alleged that her husband was away at work when she went to bed early Friday morning after making preparations for the annual Eid al-Fitr festival that weekend, said K. Manoharan, Terengganu deputy criminal investigation chief.
An hour later, she claimed a man whom she thought was her husband snuggled into bed and that they had sex although she didn't see his face, he said.
She only realized her mistake when her husband returned and asked her about seeing their guest, who is his colleague, leaving her room, he said. The couple later lodged a complaint with police that she was raped, Manoharan said.
"We are a bit suspicious on the claims made by the victim. It's strange — a woman not knowing if it's her husband or not," Manoharan told the Associated Press.
None of the three people were identified.
Police questioned the guest, a 29-year-old laborer who has been staying with the couple for the past two months, and released him on bail, he said. Investigations are continuing, he said, declining to give further information.

Bride sues over flower color
So says the bride, Elana Glatt, who was so upset that she sued the florist and alleged breach of contract.
She says Posy Floral Design in Manhattan substituted pastel pink and green hydrangeas for the dark rust and green ones she had specified for 22 centerpieces.
Not only that, she alleges that the hydrangeas were wilted and brown, and arranged in dusty vases without enough water.
"The use of predominantly pastel centerpieces had a significant impact on the look of the room and was entirely inconsistent with the vision the plaintiffs had bargained for," Glatt, a lawyer, said in the lawsuit, filed on behalf of herself, her husband, David, and her mother-in-law, Tobi Glatt, who paid for the flowers.
The flowers cost $27,435.14. The lawsuit asks for more than $400,000 in restitution and damages.
Stamos Arakas, the florist, said that he and his wife, Paula, tried to match the color of the hydrangeas with a picture Glatt had given them, but explained to her that the colors might not look the same.
"My father used to tell me, 'Don't deal with the lawyers," Arakas said. "Maybe he was right, God bless his soul."

Is this Pope John Paul II waving from beyond the grave? Vatican TV director says yes
The image, said by believers to show the Holy Father with his right hand raised in blessing, was spotted during a ceremony in Poland to mark the second anniversary of his death.
Details appeared on the Vatican News Service, a TV station in Rome which specialises in religious news broadcasts.
Father Cielecki said he was convinced the picture showed the former pontiff.
"You can see the image of a person in the flames and I think it is the servant of God, Pope John Paul II," he said.
The pictures were being broadcast continuously on Italian TV and also posted on religious websites, some of which crashed as thousands logged on to see for themselves the eerie figure formed by the flames.
The bonfire was lit during a service at Beskid Zywiecki, close to John Paul's birthplace at Katowice, southern Poland, on April 2 - the second anniversary of his death.
Hundreds had attended the ceremony. Gregorz Lukasik, the Polish man who took the photographs, said: "It was only afterwards when I got home and looked at the pictures that I realised I had something.
"I showed them to my brother and sister and they, like me, were convinced the flames had formed the image of Pope John Paul II.
"I was so happy with the picture that I showed it to our local bishop who said that Pope John Paul had made many pilgrimages during his life and he was still making them in death."
A real hero......
"I don't think it should not be a problem to insult a religion, because it should be possible to insult all religions in a democratic way, " says Vilks from his home in rural Sweden.
"If you insult one, then you should insult the other ones."
His crude, sketched caricature shows the head of Prophet Mohammed on the body of a dog. Dogs are considered unclean by conservative Muslims, and any depiction of the prophet is strictly forbidden.
Vilks, who has been a controversial artist for more than three decades in Sweden, says his drawing was a calculated move, and he wanted it to illicit a reaction.
When it's suggested that might prove an arrogant -- if not insulting -- way to engage Muslims, he is unrelenting, even defiant.
"No one actually loves the truth, but someone has to say it," he says.
Vilks, a self-described atheist, points out he's an equal opportunity offender who in the past sketched a depiction of Jesus as a pedophile.
Still one could argue Vilks should have known better because of what happened in Denmark in 2005, when a cartoonist's depictions of the prophet sparked violent protests in the Muslim world and prompted death threats against that cartoonist's life.
Vilks' cartoon, which was published in August by the Swedish newspaper Nerikes Allehanda, hasn't reached that level of global protests, although it has stoked plenty of outrage.
Muslims in Sweden demanded an apology from the newspaper, which has stood by Vilks on his freedom of expression stand. Pakistan and Iran also lodged formal protests with Sweden.
One Swedish Muslim woman who lives just an hour-and-a-half drive from Vilks said she hopes to make good on the al Qaeda threat and slaughter Vilks like a lamb.
She adds, "If I get the opportunity."
Dressed in a black burqa from head to toe and uttering death threat after death threat, the woman -- a wife and mother -- says she is defending her religion and her prophet if she manages to kill Vilks.
Amatullah has already been fined for issuing death threats. Still, she claims she will never stop taunting him.
Swedish police, who declined CNN's request for an interview, have advised Vilks to abandon his home.
But the artist still works there by day and travels to a safe house by night. Vilks knows his defiance could get him killed, but he says his art is worth dying for.
As he sits at his computer, his phone buzzes with a text message. Another death threat has just come in, this one from Pakistan.
"I will kill you, you son a bitch," he reads.
"You get used to it," he says. "It's a bit of hide and seek. It's like living in a film."
Two different break-in's.........
KENAI, Alaska (AP) - A man awakened by a bump in the night went to investigate and found an intruder, but it wasn't a burglar. Instead, Blaine Harling found himself face to snout with a black bear that had come in through an open window.
Harling, 19, has been staying at the cabin belonging to his grandparents, Vic and Jill Harling. Vic Harling said his grandson was sleeping in the basement Oct. 7 when a noise upstairs woke him.
"He thought it was the blinds flopping in the window from a two feet wide, by five feet high, crank-out window that he had left open for ventilation," he said.
The screened window was open just 18 inches, but that was enough for the adult black bear to slip through
"He walked into the kitchen and it was just standing there, about three feet away, in front of the refrigerator," Harling said. "So he grabbed the first thing he could which was a shampoo bottle, or a lotion bottle, something like that, and he whipped it at the bear and then he took-off back down to basement."
Harling pushed a dresser in front of the door and called Alaska State Troopers, who contacted the Alaska Department of Fish and Game.
The teenager also called his grandparents. After he persuaded them he wasn't joking, they told him how to unlock their gun cabinet and he armed himself with a .44-caliber and a .45-caliber handgun, said Jill Harling.
Wildlife technician Larry Lewis reached the Harling's cabin at about 2 a.m. The emergency officials blasted a siren to frighten the bear.
"We spotlighted the house and saw a big black bear out back in the alders, but we couldn't say for certain that it was the same bear," Lewis said.
Lewis and state troopers searched the two-story home to make sure it contained no bears.
"We went room to room, but there were no other signs, so the bear we saw out back must have been the same one that was seen inside," Lewis said. "We think it went out the same window it came in, which was pretty lucky for the homeowner. Had it been a brown bear, they usually exit by making their own hole."
Jill Harling said her grandson created more of a mess by splattering the lotion bottle off the bear's head than the bear did. She and her husband, awakened shortly after 1 a.m. by their grandson, reached the cabin by about 6 a.m.
"It moved a few things around, ate a few muffins that were left out, pulled the garbage out and spread it around, and left nose and paw prints on mirrors and the TV., but there was no real damage," said Vic Harling. "It was amazing really. It didn't even knock over lamps near where it came in."
What the family believes was the same bear appeared on their deck that night. This time, all entrance point to the house were secured.
They're keeping their firearms closer in case the bear returns.
"I wouldn't mind having some bear meat in the freezer," Jill Harling said

Woman, 81, Shoots Homeless 'Washer'
MOBILE, Ala. (AP) - An 81-year-old woman shot a homeless man Monday morning after finding him washing his clothes in her laundry room, police said.
Ethel Sanders told people she heard noises in her laundry room and found a man standing in his underwear near the washing machine when she went to investigate, police spokesman Officer Eric Gallichant told the Press-Register.
Sanders was carrying a handgun and shot the man when he came at her, Gallichant said. Sanders fell to the ground and dropped the gun after firing, Gallichant said.
The man grabbed the gun, pointed it at Sanders and took his clothes from the washing machine, Gallichant said.
The man fled and Sanders called police just before 8 a.m. Officers caught the man at the nearby Plateau Community Center.
James Penn, 25, was taken to University of South Alabama Medical Center. Gallichant said he is expected to survive. Upon release from the hospital, Penn will be charged with first-degree burglary, Gallichant said.
i guess he should have been in the frig when she caught him. why doesnt he just take some of the money he begs from people and use a laundromat? of course, if he was rational he probably wouldnt be homeless now would he. you gotta love an old ladty with a handgun. i put it right behind a one-eyed nun with a bottle of whiskey and a bullwhip.

A lemonade stand wouldnt do, huh?
CHICAGO — Police last week arrested five people after a Craigslist ad promised live sex and sex acts in a Chicago apartment building near a school and a church, MyFoxChicago reports.
"Being that we have a lot of children around here, it brings the wrong message to the neighborhood," one Humboldt Park resident said.
Police said the ad promised an "erotic live show" where couples would have sex. In addition, refreshments would be served and cameras allowed for $240. For $200 more, attendees could receive sex acts, the report said.
The five arrested include Denis Kelly, 60, the building's owner; Praveena Omakupe, 22; Lauren Dunne, 22; Augustus Lewellen, 22; and Quncy Gilbert, 30, who face multiple charges including prostitution.

Embattled Calif. Dentist Says Breast Rubs Necessary
Police say Anderson said during recorded phone calls that he routinely massaged patients' chests to treat temporo-mandibular joint disorder, or TMJ, which causes neck and head pain.
Attorney Robert Zaro told administrative law judge Jonathan Lew at a hearing Thursday that he should let Anderson keep his dental license while disciplinary appeals proceed. Anderson would be supervised by two assistants and would no longer do the chest rubs, Zaro said.
Zaro said Anderson, 48, of Woodland, needs to keep seeing patients so he can feed his seven children and pay for his defense.
The judge made no immediate decision.
Lew suspended Anderson's dental license last month. He was charged with two misdemeanor counts of battery and sexual battery. Yolo County prosecutors are investigating complaints from more than two dozen women who say they also were groped in the examining chair in the last five years.
Deputy Attorney General Jeffrey Phillips gave Lew three new complaints, including one from a 31-year-old woman who said Anderson fondled her at least six times over two years.
She took to wearing tight shirts with high necklines, "and Anderson would still get in under her shirt and bra," according to a police report.

Not even a sex-sting arrest and an on-again, off-again guilty plea can keep Idaho's senior senator from induction into the pantheon of Gem State greats.
His GOP colleagues in the U.S. Senate may wish him gone. But Larry Craig will always have a home in the Idaho Hall of Fame. This Saturday in Boise, Craig will join 11 other distinguished citizens of the Gem State in what promises to be a squirm-worthy induction ceremony. Since its creation in 1995, the Hall of Fame, a nonprofit organization, has been honoring the state's leaders and historical figures—including World War II flying ace Gregory (Pappy) Boyington, actress Lana Turner and Sacagawea, the American Indian woman who helped guide the Lewis and Clark expedition. Organizers bristle at the suggestion that Craig should be disinvited following the uproar over his guilty plea for disorderly conduct in a restroom sex sting, and his refusal to resign from the Senate as he'd initially discussed—even after a Minneapolis judge last week rejected his motion to withdraw the guilty plea. "He was nominated well before this happened," says Hall of Fame president Charles Indermuehle. "We will have our dinner, and we're looking forward to it."
It may be the most determined culinary performance since Martha Stewart appeared on the CBS "Early Show" grimly chopping cabbage after she was indicted on federal charges of insider trading. "There are times when we've tried our damnedest to get some publicity," says Hall of Fame board member William Vaughn Jr., adding that the organization stuck with Craig because of his record representing Idaho in Congress for 27 years. "He sure as hell isn't being honored for the last few months," Vaughn says. "We try to look beyond personalities and look at the facts of what they've accomplished." Still, he admits it's hard not to cringe at reminders of Craig's newfound fame—such as the sticker he saw in a men's room during an out-of-state vacation proclaiming CRAIG WAS HERE. (The vote to include honorees in the Hall of Fame is made by a subcommittee of the board and then approved by the entire group. That process was completed before news of Craig's arrest was made public.)
Although the Hall of Fame is still trying to raise money to build a museum (one can only imagine the Craig exhibit), Saturday's ceremony, featuring a dinner, plaques and handshakes, promises to be exquisitely awkward. (Pre-printed invitations to the ceremony laud Craig's service this way: "Thirty years of exemplary political service to the State of Idaho and the country speaks for itself.") But while the late-night talk-show hosts sharpen their blades, and the blogs snicker about the "Idaho Hall of Shame," the humor is lost on others. "He seems to have the hide of a rhinoceros," says fellow honoree Arthur Hart, a Boise historian who plans to bring his grandchildren and great-grandchildren to the ceremony. "I wish he wouldn't come. That isn't very nice for the rest of us."

While Idahoans are a forgiving—and stoic—lot, it has not been easy becoming the butt of a nation's jokes. A recent poll by local television station KIVI found that 51 percent of Idahoans oppose Craig's decision to stay in the Senate. Several of Craig's fellow hall-of-famers have become players the "will he or won't he?" resignation saga. Gov. C.L. (Butch) Otter, who will also be inducted Saturday, scrambled to put together a list of replacements after Craig signaled his intention to resign. Otter, a fellow Republican who has said publicly "it would be best for Idaho" if Craig left the Senate, spent hours vetting potential candidates only to find out that there wouldn't be a vacancy after all. Lt. Gov. Jim Risch, who plans to be right there gripping and grinning onstage, announced this week that he intends to run for Craig's seat—whether or not the incumbent is still in it—in next year's election. Declaring his candidacy, Risch acknowledged the "considerable personal suffering" Craig and his family have endured, but added, "it's really time for Idaho to move forward." Other nominees include local television news anchor Dee Sarton, who has been reporting the Craig scandal for months. One honoree who may have chosen the wisest course: Boise State football coach Chris Petersen, nominated for his role in leading the school's team to its 2006 Fiesta Bowl victory over the University of Oklahoma Sooners, can't make it, says a spokesman. He's got a game the next day.

Sen. Craig to File Appeal Over Judge's Refusal to Withdraw Guilty Plea
BOISE, Idaho — Sen. Larry Craig says he will file an appeal Monday over a judge's refusal to allow him to withdraw his guilty plea stemming from his arrest in an airport bathroom sex sting.
In an interview Sunday with KTVB-TV, Craig repeated he will not resign his post in the Senate and said he will continue to work his legal options.
"It is my right to do what I'm doing," said Craig, an Idaho Republican. "I've already provided for Idaho certainty that Idaho needed — I'm not running for re-election. I'm no longer in the way. I am pursuing my constitutional rights."
Craig pleaded guilty to disorderly conduct in August after he was accused of soliciting sex in a bathroom at the Minneapolis-St. Paul airport in June.
After the matter became public, Craig tried to withdraw his plea. But a judge in Minnesota refused, saying Craig's plea "was accurate, voluntary and intelligent, and ... supported by the evidence."
